I would say yes, you have to have an actual soul for the Hougyku to bind with. The Hougyuku was put in a gigai so that the Hougyuku could fuse with the users soul when they entered the Gigai. I doubt a mod soul could do the job, but I'm sure Urahara could have made one, but just didn't have the time. He may have also chose Rukia because he could easily keep his eye on her. She frequented Karakura town, and knew that the only other place she really goes is SS. Since he knew Rukia was Byakuyas little sister, he knew Byakuya wouldn't allow her to get into a heavy combat situation, and that she would also be protected, and that at worst, the Hougyuku would go back to SS (where it would be safe from Hollows anyways). So actually, Rukia was an excellent choice for him to hide the Hougyuku, especially if he did it in a hurry like I think he did. He just didn't plan on Aizen finding it. He hid it underneath the noses of the Gotei 13 for the entire time Rukia was imprisoned.
